Cloudifi Terms of Service

1. Legal Compliance and Use of Services

Cloudifi is a Limited Liability Corporation (LLC) operating in accordance with the laws of the State of Texas. Our services must only be used for lawful purposes. The transmission, storage, or presentation of any content that violates federal, state, or local laws in the United States is strictly prohibited. This includes, but is not limited to, material that is copyrighted, threatening, obscene, harmful, or protected by trade secret laws. Clients agree to defend, indemnify, and hold Cloudifi harmless against any claims arising from the misuse of our services.

2. Service Reliability and Functionality

Cloudifi provides reliable hosting services, including secure website hosting and seamless email functionality. Email usage must comply with Cloudifi’s anti-spam policies and rate limits. Service failures caused by misconfigured DNS records, website settings, or third-party errors are not considered failures of Cloudifi’s core functionality.

3. Domain Management and Acceptable Use

Clients are responsible for managing any domains added to or hosted on Cloudifi’s systems. Domains associated with spam, scams, fraudulent activities, or illegal content are strictly prohibited. Cloudifi reserves the right to assess and determine the legitimacy of domains and may suspend or terminate any domain that violates these standards.

4. Web Hosting and Security Standards

Clients are responsible for maintaining the security and functionality of websites hosted on Cloudifi’s infrastructure. This includes regularly updating scripts, plugins, and applications to mitigate security vulnerabilities. Hosting content that includes phishing schemes, malware, fraudulent information, hate speech, or offensive material is not allowed. Additionally, websites promoting adult content, gambling, illegal drugs, extremist content, or any form of illegal business activity are strictly prohibited.

5. Professional Conduct and Support Interaction

Cloudifi is committed to maintaining a professional and respectful environment for all clients and staff. Abusive behavior, harassment, threats, or any form of disrespect toward Cloudifi’s support team will result in immediate termination of service without a refund. This includes threats of initiating chargebacks or payment disputes.

6. Server Abuse and Resource Usage

Any attempt to compromise the performance, security, or stability of Cloudifi’s servers is prohibited. Clients are responsible for ensuring their accounts and activities do not negatively impact other users. Misuse of system resources may result in termination of services or suspension of accounts. Depending on the severity, warnings may be issued before action is taken.

7. DNS and Email Configuration Requirements

Clients using Cloudifi’s email services are required to maintain valid SPF and MX records to ensure proper email delivery and prevent spam issues. Failure to comply may result in service suspension to protect Cloudifi’s network integrity and email reputation.

8. Right to Refuse or Terminate Service

Cloudifi retains the absolute right to refuse, suspend, or terminate services at our sole discretion if we determine that client activities threaten service quality, violate applicable laws, or compromise network integrity.

9. Prohibited Activities and Services

The following activities and services are explicitly forbidden on Cloudifi’s platform:\n\n- Hosting forums or platforms that leak compromised user information.\n- Distributing explicit, pornographic, or adult content.\n- Running mass mailing campaigns without proper double opt-in procedures.\n- Engaging in deceptive practices or misrepresenting identity or service affiliation.\n- Excessive email forwarding exceeding 300 emails per hour.\n- Sending SMS messages via email or conducting unauthorized marketing campaigns.\n- Operating websites involved in counterfeit goods or illegal e-commerce activities.\n\n10. Email and Sender Integrity

Emails sent using Cloudifi’s services must be intended for human recipients. Sending excessive automated emails that are unlikely to be read by human users is prohibited and may be blocked. Additionally, spoofing or misrepresenting sender email headers from domains not owned by the client is strictly forbidden.

11. Email Delivery and Spam Management

Repeated delivery attempts to invalid email addresses may result in those addresses being blocked in Cloudifi’s email filters. Email spam complaints can lead to outbound email blocking to protect Cloudifi’s IP reputation and maintain service integrity.

12. IP Reputation and Security

Activities that damage Cloudifi’s IP reputation, such as compromised accounts due to poor password management, may result in immediate termination of service without refund.

13. Data Backup Policy

Cloudifi conducts regular backups of client accounts to safeguard data in case of hardware failure. However, backups are provided as a courtesy and are not guaranteed. Clients are encouraged to maintain their own backups as an additional safeguard.

14. Billing, Payments, and Account Suspension

Cloudifi bills clients on a monthly basis via automated methods, including PayPal and credit card payments. Late or insufficient payments will result in immediate suspension of services, with potential account termination if payments are not resolved within 24 hours.

15. Refund and Chargeback Policy

Refunds are not provided unless Cloudifi explicitly fails to meet guaranteed service standards. Initiating chargebacks or payment disputes violates Cloudifi’s policy and may result in immediate account termination, with a $50 administrative fee applied.

16. Accuracy of Client Information

Clients are responsible for maintaining accurate and up-to-date billing and contact information. Inaccurate information may lead to suspension or termination of services.

17. Limitation of Liability

Cloudifi is not responsible for incidental, consequential, or punitive damages resulting from service interruptions, data loss, or server downtime. Liability is strictly limited to the immediate termination of the affected service.

18. Reporting Violations

To report a violation of this policy, contact Cloudifi’s abuse department at abuse@cloudifi.com. All reported violations will be investigated thoroughly, and appropriate action will be taken.

19. Privacy and Data Protection

Cloudifi respects client privacy and does not disclose information unless required for fraud prevention, spam investigations, or by law enforcement. While login activities and email logs may be monitored for security purposes, they are not accessed without proper authorization.

20. Policy Updates and Amendments

Cloudifi reserves the right to amend these terms at any time without prior notice. Continued use of Cloudifi’s services constitutes acceptance of any revised terms.
